General Terms

Neurotech Design ("Neurotech Design'' or “We” or the "Company") offers its users (“Referrer” or “You”) the opportunity to participate in its referral program (the “Program”). We reserve the right to amend or terminate the Program at any time, for any reason. The Program is administered by Neurotech Design. To participate in a Referral Program, You must agree to these Referral Terms set forth herein, which become part of the Terms & Conditions. These Referral Terms constitute a valid and legally binding agreement between You and Us. By participating in the Referral Program, You agree to be bound by the Referral Terms provided herein.

 

Eligibility Terms

(i) By participating in the Program, Referrers agree to use the Program in the manner specified in these Terms and Conditions. (ii) If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as a Referrer or to participate in the Program in any other manner. (iii) You agree that the Referral Program is valid only for users of the Wellness mobile application. (v) Referral Program is voluntary and any purchase or transaction on the Wellness mobile application shall be deemed as acceptance of these Referral Terms. (iv) Referrers may not participate in the Program where doing so would be prohibited by any applicable law or regulations. (vi) No part of the program is directed to persons under the age of 18. IF YOU ARE UNDER 18 YEARS OF AGE, you may not use, access or participate in the program at any time or in any manner.

 

HOW THE PROGRAM WORKS ?

 

A) Participation -

1. To participate in the Program, Referrers should visit Neurotech Design website and follow the on-screen instructions to refer friends or colleagues to the program by entering their contact information in the relevant fields.

2. Individuals who receive a referral via a Referrer are "Friends" (or, singly, a “Friend”). An "Eligible" Referrer who is fully compliant with these Terms and Conditions may receive "Reward(s)" for every "Qualified Referral”.

3. Referrers must respect the spirit of the Program by only referring real individuals who meet the requirements of these Terms and Conditions. Referrers cannot refer to themselves. For example, a Referrer may not create multiple or fake accounts with the Wellness app or participate in the Program using multiple or fake email addresses or identities.

4. By participating in the Program, a Referrer represents that he or she has her Friends’ prior consent to provide their contact information.

 

B) Making a Referral -

A Referrer must register at Wellness App to make a referral. No previous purchase is required (purchasers and non-purchasers alike are eligible). Once a Referrer refers a Friend, he/she will be provided with a confirmation email, and will be contacted if a Qualified Referral is made by the referred Friend within 3 months.

 

CRITERIA TO EARN A REFERRAL POINT :-

1. The Email ID and/or phone number through which the Referral Recipient or Friend signs up on the Wellness app, must not have been used for signing up with the Wellness app earlier.

2. The value of the Referral Discount will be as per the Company’s Referral Program active at the time of Referral Recipient's signup using the Referral Code.

3. It is clarified that the Company reserves the right to exercise discretion with regard to issuance of Referral Discount so as to combat fraudulent transactions.

4. Usage of the Referral Discount may be subject to additional terms such as minimum order value, days of use, timing etc. The Company may notify such additional terms and applicability from time to time.

5. The Referral Code shall not be duplicated, sold or transferred in any manner, or made available to the general public.

6. The Referral Program is meant to reward our privileged and loyal customers and is not meant for sharing the Referral Code on any communication medium, including, but not limited to, print, digital or electronic means, websites, or any means for any purpose whatsoever.

7. The Company reserves the right to revoke the Referral Discount or suspend a Customer’s account at any time if such sharing of the Referral Code is in contravention of these Referral Terms.

8. Only one Qualified Referral can be earned for each Friend, up to a maximum of ten (20) Friends per calendar year, unless otherwise allowed by Neurotech Design.

9. Any additional or subsequent purchases made by a Friend will not be considered Qualified Referrals and thus not be entitled to the benefits of Qualified Referrals.

 

TERMS FOR CHANGES IN THE REFERRAL PROGRAM :-

1.The Company at its sole discretion may convert the value of the Referral Discount into any other form of credit, whatsoever, including but not limited to, the Company money credit. You acknowledge and agree that You will not receive any cash equivalent, or refund either in the form of coupons or Money, for the Referral Discount.

2.The Company reserves the right to discontinue the Referral Discount without assigning any reasons or without any prior intimation whatsoever to You. In case of any dispute, the Company's decision shall be binding on You. 3.The Company reserves its absolute right at any time to add, alter, withdraw, modify or change or vary any or all the Referral Terms at its sole discretion and the same shall be binding on the Customer at all times.

 

TERMS IN CASE OF ABUSE/FRAUD OF REFERRAL SCHEME :-

1. You acknowledge and agree that creating multiple Customer’s accounts using multiple email addresses or signing in from multiple devices in order to unduly gain Referral Discount shall be considered to be in contravention to these Referral Terms.

2. The Company reserves the right to revoke the Referral Discount or suspend a Customer’s account at any time, if it is believed that such an account is being misused or the Referral Terms are being violated.

3. The Company reserves the right to deny honouring the Referral Discount on the grounds of suspicion or abuse of the Referral Program by any Customer without providing such a Customer any explanation thereof. 4. Any taxes, cess, liabilities or charges payable to the Government or any other authority or body, if any, shall be borne directly by the Customer. 5. In no event, shall the Company be liable for any abuse or misuse of the Referral Code due to the negligence of the Customer.

 

Eligibility

Must be at least 18 years old to be eligible for benefits and are non-transferable or redeemable for cash. The customer is responsible for all taxes and local requirements and fees. Program and awards are conditional on and subject to local laws and regulations. The customer may not be an employee, legal representative or partner of Neurotech Design Pvt Ltd or any Affiliate of Neurotech Design Pvt Ltd . Nothing in the Referral Program shall be deemed to create any kind of relationship between the referrer and Neurotech Design Pvt Ltd or any of Neurotech Design Pvt Ltd’s Affiliates. The referrer has no authority to represent or bind Neurotech Design Pvt Ltd. Terms and conditions are subject to change.

 

Good Faith

We introduce programs such as these in good faith and expect the same good faith in return. Please note that we may withhold awards where we believe customers are acting in bad faith or otherwise acting contrary to the intent of this program. To be clear, commercializing, advertising, publishing, mass distributing, selling or paying for use of referral links is not appropriate, and we will not honor such links. We cannot cover every nefarious scenario, nor will we attempt to, but we do promise to be fair and reasonable. Not OK: Advertising, Spam, Anything misleading or annoying, Social media bios, Paying or offering incentives for use of your link, Referral code aggregation, including posting to deal and coupon sites OK: YouTube channels, Informational & fan websites, Social media sharing

 

MISCELLANEOUS

1. If any provision in these terms and conditions are held to be invalid, void or unenforceable, such provision will be struck and the same shall not affect the validity of and enforceability of the remaining provisions.

2. These terms and conditions shall be governed by and construed in accordance with the laws of India, and any dispute or claim arising out of or relating to these Referral Terms will be adjudicated exclusively before a competent court in Mumbai.

3. Any personal data collected for the purposes of the Referral Program will be processed in accordance with the provisions of the privacy-policy.
